U.S. Court of Appeals Case No: 21-1875
U.S. District Court for the District of Minnesota
[PUBLISHED] [Stras, Author, with Erickson and Grasz, Circuit Judges]
Civil case - Contracts. The district court correctly determined that
plaintiff could not recover under the consequential-damages exclusion
provision in the parties' contract; such a provision is not unconscionable
under Minn. Stat. Sec. 336.2-719(3) and is enforceable even if plaintiff's
remaining contract remedy fails of its essential purpose under Sec.
336.2-719(2).
