Criminal case - Sentencing. Defendant invited the district court to
classify 18 U.S.C. sec. 922(q) as a Class D felony rather than a
misdemeanor and since he invited the alleged error, he is foreclosed from
asserting on appeal that Sec. 922(q) should be classified as a
misdemeanor; the sentence imposed, an upward variance, was not
substantively unreasonable. Judge Grasz, dissenting.
