Plaintiff worked for ITS, which contracted to provide railcar-switching service for KCSR; he was injured when a KCSR dispatcher directed his engine onto a track already occupied by stationary cars; he received a workers' compensation settlement from ITS and then sued KCRS, which does not have workers' compensation insurance, for the dispatcher's negligence. The district court correctly determined KCSR was exempt from liability under Missouri's workers' compensation law because plaintiff was insured by ITS, his immediate employer - see Mo. Rev. Stat. Sec. 287.040.3.
