U.S. Court of Appeals Case No: 21-2406
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Benton, Author, with Shepherd and Stras, Circuit Judges]
Criminal case - Criminal law. The district court did not err in denying
defendant's motion to suppress the search which yielded the firearm and
ammunition in question in the case as the officer applying for the search
warrant had an objectively reasonable belief in the existence of probable
cause and the search warrant affidavit contained sufficient indicia of
probable cause; there is no evidence the officer acted in bad faith; it
was objectively reasonable for the officer to rely on the warrant; as a
result, the district court properly concluded the Leon good-faith
exception applied.
