U.S. Court of Appeals Case No: 21-2493
U.S. District Court for the Southern District of Iowa - Central
[PUBLISHED] [Smith, Author, with Wollman and Erickson, Circuit Judges]
Civil case - Civil rights. In this Section 1983 action, plaintiffs,
licensed foster parents, alleged defendants failed to afford them an
opportunity to be heard on child abuse allegations before issuing a found
child abuse report and placing them on the Iowa Child Abuse Registry. The
district court granted defendants' motion for summary judgment and
plaintiffs appeal. Held: Plaintiffs failed to prove that the law was
clearly established such that the defendants should reasonably have been
expected to know that an interim finding of child abuse pending the
interview of plaintiffs violated plaintiff Billie Hovick's right to due
process; as a result, defendants were entitled to summary judgment based
on qualified immunity.
