U.S. Court of Appeals Case No: 21-2559
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Shepherd, Author, with Smith, Chief Judge, and Colloton,
Circuit Judge]
Criminal case - Criminal law and sentencing. The evidence was sufficient
to support defendant's conviction for attempted inducement of a minor for
sexual activity; the district court did not err in refusing to give
defendant's proposed jury instruction on entrapment; nor did the court err
in refusing to instruct the jury on the term "coerce" as it appears in 18
U.S.C. Sec. 2422(b); nor did the court err in removing the word from the
final instruction as there was no evidence of coercion in the case; the
district court did not err in denying defendant's request for a downward
departure and variance as his advisory range was properly calculated and
he offered no mitigating circumstances not already accounted for in the
Guidelines.
