U.S. Court of Appeals Case No: 21-2571
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Smith, Author, with Benton and Kelly, Circuit Judges]
Civil case - Torts. The district court did not err in granting defendant's
motion for summary judgment in this trip-and-fall case, as there was no
genuine issue of material fact as to whether the "lip" formed by the
junction of the parking lot and sidewalk was a dangerous condition;
because the existence of a dangerous condition is a necessary element of
premise liability under Missouri law, defendant was entitled to summary
judgment.
