Civil case - ERISA. The defendant insurer had a fiduciary role in the
deceased's attempt to seek supplemental life insurance and its ability to
determine her eligibility for supplemental life insurance made it a
fiduciary for her application process; the defendant insurer breached its
fiduciary duties of prudence and loyalty by failing to maintain an
effective enrollment system and by receiving the deceased's premiums
without giving her a corresponding benefit of coverage; the district court
did not err in granting summary judgment to the plaintiff and in holding
the defendant insurer liable for the supplemental life insurance claim.
