U.S. Court of Appeals Case No: 21-2930
U.S. District Court for the Northern District of Iowa - Eastern
[PUBLISHED] [Shepherd, Author, with Erickson and Stras, Circuit Judges]
Criminal case - Criminal law. Officers had probable cause to stop the
vehicle in which defendant was a passenger based on the facts that the
officer knew the driver did not have a valid license and the vehicle was
not displaying proper plates or tags; the officer could extend the stop
based on a reasonable suspicion that defendant and the driver were felons
in possession of firearms in the car; even if the search warrant
applications to obtain defendant's DNA and access his cell phones failed
to establish probable cause to issue the warrants, the officers acted in
good faith in executing the warrants and the evidence was admissible under
the Leon good-faith exception.
