U.S. Court of Appeals Case No: 21-2933
U.S. District Court for the Western District of Missouri - Jefferson City
[PUBLISHED] [Colloton, Author, with Benton and Stras, Circuit Judges]
Criminal case - Criminal law. Anders case. The district court did not
abuse its discretion in denying defendant's motion to withdraw his guilty
plea; given the thorough record created at the plea hearing that
defendant's guilty plea was voluntary and knowing and the district court's
finding that defendant's contrary assertions made at a later date were not
credible, there is no arguable basis for reversal; issue regarding
sentence was barred by the appeal waiver in defendant's guilty plea. The
opinion also discusses an attorney's obligations under Anders. Judge
Stras, concurring in the judgment.
