Prisoner case - Prisoner civil rights. Plaintiff, an Arkansas inmate,
alleged he was beaten by another inmate and that defendants failed to take
steps to protect him from the assault; the district court granted
defendants' motion for summary judgment based on plaintiff's failure to
exhaust his administrative remedies. The district court erred in declining
to decide whether the prison's grievance procedure was unavailable to
Smith because of medical incapacity, and the judgment is reversed and the
matter remanded for further proceedings.
