U.S. Court of Appeals Case No: 21-3376
U.S. District Court for the Western District of Arkansas - Ft. Smith
[PUBLISHED] [Gruender, Author, with Shepherd and Erickson, Circuit Judges]
Civil case - Employment discrimination. Assuming plaintiff made a prima
facie case of termination in retaliation for raising claims of race
discrimination, the defendants articulated a legitimate, non-retaliatory
ground for his discharge, failure to follow first-responder protocols,
which plaintiff failed to show was a pretext for retaliatory discharge;
the seriousness of plaintiff's conduct was evident from his body-camera
footage, and the University's brief investigation before acting did not
constitute evidence of pretext.
