U.S. Court of Appeals Case No: 21-3618
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Erickson, Author, with Gruender and Melloy, Circuit Judges]
Civil case - Civil rights. Plaintiff alleged that the City, by extending
water service to certain subdivisions, was depriving it of its right under
7 U.S.C. Sec. 1926(b) to be protected from curtailment or limitation of
its provision of water service in its service area; plaintiff's claims are
time-barred under the applicable five-year statute of limitations because
the claims accrued when the City initially provided service in 1994.
