U.S. Court of Appeals Case No: 21-3757
U.S. District Court for the Southern District of Iowa - Eastern
[PUBLISHED] [Loken, Author, with Gruender and Grasz, Circuit Judges]
Criminal case - Sentencing. The district court did not err by
cross-referencing to the base offense level for attempted first degree
murder in this felon in possession of a firearm sentencing where the
prosecution arose out of a convenience store shooting in which defendant
shot a man; any guidelines error was harmless in light of the district
court's pronouncement that it would have imposed the same sentence without
the cross-reference.
