Criminal case - Criminal case. The evidence was sufficient for a jury to
find defendant acted with intent to defraud the Social Security
Administration by receiving benefits for which he was not eligible; the
district court's restitution order is vacated as the government failed to
present evidence to show the date on which the defendant became ineligible
for benefits; without that evidence it is not possible to determine the
SSA's loss or the proper amount of restitution; the restitution and
forfeiture orders are vacated, and the case is remanded for the
presentation of additional evidence regarding the amount of the SSA's loss
and the amount defendant derived from his scheme.
