U.S. Court of Appeals Case No: 21-3849
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Smith, Author, with Kelly and Grasz, Circuit Judges]
Criminal case - Criminal law. The district court did not violate Fed. R.
Crim. P. 32.1(c)(1) when it denied defendant's motion to terminate
supervision or modify the conditions of his supervised release without
providing him with counsel and a hearing; no due-process violation
occurred; under this court's precedent in U.S. v. Mosby, 710 F.3d 925 (8th
Cir. 2013), neither 18 U.S.C. Sec. 3583(e) nor relevant case law requires
the district court to explain its denial of early termination of
supervised release; the district court did not abuse its discretion by
refusing to modify the provision on defendant's internet and computer use.
Judge Kelly, concurring.
