[PUBLISHED] [Erickson, Author, with Shepherd and Grasz, Circuit Judges] Civil case - Civil rights. Plaintiff alleged his prosecution under the County's Solid Waste Ordinance violated his civil rights. The district court did not err in determining that plaintiff failed to plausibly allege the existence of an official policy for his Monell claim against the County; nor did he allege sufficient facts to state a claim for violation of his rights through an unofficial policy; without a constitutional violation, there can be no Section 1983 liability; viewing the complaint in the light most favorable to plaintiff, he failed to plead sufficient factual content that would allow a court to draw a reasonable inference that the County fabricated evidence or prosecuted him knowing the Solid Waste Ordinance was not applicable to him.
