U.S. Court of Appeals Case No: 22-1699
U.S. District Court for the Western District of Arkansas - Ft. Smith
[PUBLISHED] [Shepherd, Author, with Gruender and Benton, Circuit Judges]
Criminal case - Criminal law and Sentencing. In case alleging deprivation
of constitutional rights through the use of excessive force, the jury was
informed as to why one of the victims was shackled in a shower room,
thereby contextualizing the housing and shackling issues for the jury, and
any error in limiting defendant's questioning on the issue was harmless;
any error in admitting the jail's use-of-force and inmate-rights policies
was harmless as there was sufficient other evidence to show the
defendant's use of force was willful; the jury instructions properly
defined the bodily injury element in 18 U.S.C. Sec. 242; the evidence was
sufficient to support defendant's convictions; no error in applying an
obstruction-of-justice enhancement under Guidelines Sec. 3C1.1 where
defendant attempted to influence a co-worker's testimony about one of the
incidents; the within-guidelines sentence was substantively reasonable.
