U.S. Court of Appeals Case No: 22-1723
U.S. District Court for the Western District of Arkansas - El Dorado
[PUBLISHED] [Loken, Author, with Arnold and Kobes, Circuit Judges]
Civil case - Bankruptcy. The bankruptcy court did not err in denying
PIRS's motion to vacate a default judgment against it; the trustee
arguably complied with Bankruptcy Rule 7004(b)(3) by serving PIRS in the
manner directed in its Proof of Claim; second, the summons and complaint
were in fact received by PIRS; third, the court did not err in reasoning
that an entity served by legal process should not benefit from its own
inaccurate or dated records when others attempt in good faith to determine
the appropriate agent for service; relief was not available under Fed. R.
Civ. P. 60(b)(6) and, even if it was, PIRS failed to show the kind of
exceptional circumstances required for relief under Rule 60(b)(6).
