U.S. Court of Appeals Case No: 22-1816
U.S. District Court for the Southern District of Iowa - Central
[PUBLISHED] [Grasz, Author, with Shepherd and Erickson, Circuit Judges]
Criminal case - Criminal law. The district court did not err in finding
that the inaccuracies in the search warrant application did not affect the
existence of probable cause to issue a warrant and did not err in denying
defendant's request for a Franks hearing; the district court did not err
in admitting evidence of defendant's 2011 conviction for possessing a
controlled substance with intent to distribute as it was relevant to the
felon in possession charge and defendant's state of mind on the drug
conspiracy charge; the evidence was sufficient to support defendant's
convictions for conspiracy to distribute a controlled substance and
unlawful possession of a firearm; the evidence supported the forfeiture of
cash seized during a search of defendant's residence; claim of Brady
violation rejected; Confrontation Clause claim rejected; defendant did not
have standing to make a Fourth Amendment claim regarding drug buy
recordings as the argument only asserts rights of others and not
defendant.
