U.S. Court of Appeals Case No: 22-2044
and No: 22-2063
U.S. District Court for the Eastern District of Arkansas - Central
[PUBLISHED] [Gruender, Author, with Kelly and Grasz, Circuit Judges]
Criminal case - Criminal law. The district court did not abuse its
discretion by denying defendant Sherman's motion to sever his case from
defendant Smith's; the evidence was sufficient to support defendants'
convictions for witness tampering; the evidence was sufficient to support
defendant Smith's convictions for conspiring to possess meth with intent
to distribute and his related firearms charge; the district court did not
err in admitting into evidence texts Smith sent his girlfriend as they
showed consciousness of guilt; the court did not err in permitting a
witness to testify that he knew Smith because they dealt drugs together
because it showed their relationship and explained why Smith shared
information about this offense; the district court further limited any
possible prejudice by giving a limiting instruction.
