U.S. Court of Appeals Case No: 22-2178
U.S. District Court for the Western District of Arkansas - Fayetteville
[PUBLISHED] [Stras, Author, with Smith, Chief Judge, and Kobes, Circuit
Judge]
Criminal case - Criminal law. The district court did not err in ruling
that defendant could not question a former employee regarding that
employee's prior sex-offense conviction, and the decision did not violate
defendant's Fifth or Sixth Amendment rights; the district court did not
err in admitting into evidence defendant's statements as a reasonable
person in defendant's position would not have believed he was in custody
at the time the statements were made to police; the district court did not
err in admitting testimony from a forensic expert regarding the metadata
on defendant's phone; nor did the court err in prohibiting defendant from
questioning his expert regarding data she never examined.
