U.S. Court of Appeals Case No: 22-2282
U.S. District Court for the District of Minnesota
[PUBLISHED] [Kelly, Author, with Colloton and Benton, Circuit Judges]
Criminal case - Criminal law. The hospital security officers' action in
seizing defendant in the stabilization room after he was brought in for
treatment of a gunshot wound was objectively reasonable as he needed
immediate medical treatment for his wound and his refusal to remove his
clothing prevented medical staff from providing potentially life-saving
treatment; further, the officers' actions were necessary to protect the
staff and other patients; the scope of the seizure was tailored to the
circumstances.
