U.S. Court of Appeals Case No: 22-2385
and No: 22-2412
U.S. District Court for the District of Minnesota
[PUBLISHED] [Benton, Author, with Smith, Chief Judge, and Colloton,
Circuit Judge]
Criminal case - Criminal law and Sentencing. Challenge to the scientific
reliability of drug identification field tests rejected; photo of drug
pipe was properly admitted even if it was not referenced in police reports
or the inventory of items seized; evidence was sufficient to support
defendant's conviction for possession of a firearm by a felon as the .45
caliber handgun was a firearm for purposes of 18 U.S.C. Sec. 921(a)(3) and
922(g); the issue of whether the district court erred in applying an
obstruction-of-justice enhancement was moot as defendant's base offense
level was set by his status as an armed career criminal; no error in
imposing an enhancement under Guidelines Sec. 4B1.4(b)(3)(A) for
possession of the firearm in connection with a controlled substance
offense.
