Criminal case - Criminal law. Defendant could have inquired about the
racial composition of jury pools before the pre-trial motion deadline, and
the district court did not err in denying as untimely his post-deadline
motions challenging the jury pool composition; the evidence was sufficient
to support defendant's conviction for assault under 18 U.S.C. Secs. 111,
1114 as a reasonable jury could have found that the jail officer defendant
assaulted was assisting the U.S. Marshals in its duty to provide for the
safekeeping of federal detainees; the jury instructions on assault were
not erroneous; evidence of defendant's arrest for selling heroin was
probative of his participation in the charged conspiracy and was properly
admitted.
