U.S. Court of Appeals Case No: 22-2602
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Colloton, Author, with Loken and Erickson, Circuit Judges]
Criminal case - Criminal law. Brady/Giglio claim rejected as defendant
discovered the materials in question during the trial and used them to
cross-examine the victim; the district court did not err in denying
defendant's motion for a new trial based on claim that a federal agent
coached the victim prior to her cross-examination as the claim was
speculative, was denied by the agent, and concerned an immaterial matter;
further, defendant had an opportunity to cross-examine the witness about
inconsistencies between her testimony and the records in question;
evidence was sufficient to support defendant's conviction for sex
trafficking by fraud.
