U.S. Court of Appeals Case No: 22-2818
U.S. District Court for the District of Minnesota
[PUBLISHED] [Colloton, Author, with Loken and Erickson, Circuit Judges]
Civil case - Civil rights. Edina police officers shot and killed
plaintiff's husband as he ran towards them with a large knife; she brought
this action alleging the excessive use of force that resulted in an
unreasonable seizure under the Fourth and Fourteenth Amendments; the
district court granted defendants' motion for summary judgment, concluding
the use of force was objectively reasonable. The district court did not
err under these facts in concluding the officers' use of force was
objectively reasonable because plaintiff's husband presented an imminent
threat of death or serious injury to the officers.
