U.S. Court of Appeals Case No: 22-3007
U.S. District Court for the Western District of Arkansas - Ft. Smith
[PUBLISHED] [Benton, Author, with Grasz and Stras, Circuit Judges]
Civil case - Asset Forfeiture. The district court struck Hester's claim as
a sanction for violating Rule G(6) by providing incomplete information
regarding his claim, including insufficient responses to the government's
interrogatories; the district court erred in striking the claim under Rule
G(8) as this court cannot conclude, on this record, that Hester knew or
should have known that Rule G(6) obligated him to provide more information
than had been provided.
