1983 for costs plaintiff incurred while a stop-work order was in place
concerning its property development, the district court correctly
determined that the defense of res judicata was timely asserted and that
it applied; the claims asserted in the new action could have been brought
in the earlier state court action, the identity of things sued for was
met, as was the identity of the cause of action; the order granting
defendants summary judgment is affirmed.
