U.S. Court of Appeals Case No: 22-3066
U.S. District Court for the District of Nebraska - Lincoln
[PUBLISHED] [Benton, Author, with Colloton and Shepherd, Circuit Judges]
Civil case - Immigration. Plaintiffs brough this action to compel the U.S.
Customs and Immigration Service to promptly adjudicate their status
adjustment applications, asserting the Services' decision to delay
adjudicating them, pursuant to the Adjudication Hold Policy, violates
congressional intent. The district court denied their request for
temporary restraining order, and plaintiffs appeal. Held: the court lacks
jurisdiction under 8 U.S.C. Sec. 1252(a)(2)(B)(ii) to review the Attorney
General's discretionary decisions, and the appeal is dismissed for lack of
subject-matter jurisdiction.
