[PUBLISHED] [Benton, Author, with Grasz and Stras, Circuit Judges] Civil case - Civil rights. Plaintiff, suing on behalf of her son, alleged defendant, a City of Cedar Rapids policeman, used excessive force by not giving the boy a warning while searching with a canine trained to bite and hold; the district court denied defendant's motion for summary judgment based on qualified immunity, and defendant appeals. The district court's order is affirmed as there was a genuine issue of fact as to the adequacy of the warnings and the law was clearly established that the defendant had to give a warning and provide the suspect with a chance to surrender. Judge Grasz, dissenting.
