U.S. Court of Appeals Case No: 22-3275
U.S. District Court for the Southern District of Iowa - Eastern
[PUBLISHED] [Colloton, Author, with Loken and Erickson, Circuit Judges]
Criminal case - Sentencing. The district court did not err in determining
defendant's conviction for domestic assault with the use or display of a
weapon was a crime of violence for purposes of calculating defendant's
base offense level - see U.S. v. McGee, 890 F.3d 730 (8th Cir. 2018) and
U.S. v. Shannan, 66 F.4th 117 (8th Cir. 2023); remanded to the district
court to amend the statement of reasons to reflect that the court did not
resolve defendant's objection to the presentence report regarding
defendant's gang affiliation.
