U.S. Court of Appeals Case No: 22-3335
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Loken, Author, and Erickson and Kobes, Circuit Judges]
Civil case. In this auto accident case, the district court did not err
when it excluded a medical doctor's expert testimony because the doctor's
causation opinion was not formed during the course of treatment; the
district court did not err in classifying the doctor as an expert who must
filed a written report under Fed. R. Civ. P. 26(a)(2)(B) and in excluding
the testimony even though plaintiff had filed an adequate Rule 26(a)(2)(C)
disclosure.
