[PUBLISHED] [Erickson, Author, with Benton and Kobes, Circuit Judges] Civil case - COVID. For the court's prior opinion in the matter, see The Arc of Iowa v. Reynolds, 33 F.4th 1042 (8th Cir. 2022), where the court vacated as moot a preliminary injunction enjoining enforcement of Iowa Code Sec. 280.31 on the grounds the circumstances surrounding COVID-19 vastly differed from those at the time the injunction was issued. On remand, the district court granted plaintiffs' motion for summary judgment and issued two declarations concerning interpretation and application of the statute. The Governor of the State of Iowa appeals, and the district court's order is vacated and remanded with instructions to dismiss the action for lack of standing; plaintiffs have failed to show that they have suffered an injury in fact that is concrete, particularized and actual or imminent.
