Criminal case - Criminal law. While the expert witness's testimony
regarding the victim's response to the sexual assault charged in the case
came close to improper vouching, any error in admitting the testimony was
harmless, as the vouching was indirect, and defendant made several
inculpatory statements to police from which the jury could have
independently concluded defendant committed the crime; on this record,
defendant was not entitled to an intoxication defense instruction; the
district court did not err under Rule 106 in refusing to admit additional
portions of statements defendant made to the police as the excluded
portions were self-serving hearsay and were not required to alleviate a
misleading impression.
