Criminal case - Sentencing. Where defendant conceded he shot at two people
after a dispute inside of a nightclub, the district court did not clearly
err in finding that defendant had the specific intent to kill, that he
acted with premeditation, and that he escalated the situation by
continuing the confrontation outside of the club; the district court thus
did not err in applying a Guidelines cross-reference for attempted murder
or in rejecting defendant's self-defense argument when calculating his
base offense level at sentencing.
