U.S. Court of Appeals Case No: 23-1676
U.S. District Court for the District of South Dakota - Southern
[PUBLISHED] [Smith, Author, with Loken and Colloton, Circuit Judges]
Criminal case - Criminal law. Police had probable cause to search
defendant's vehicle based on 911 calls, statements from his ex-girlfriend
(whom he had just threatened) and their observation of a wooden object
(which looked like a firearm grip) sticking out of the center console of
the car; the tree in this case was not poisonous, so its fruit was
admissible.
