U.S. Court of Appeals Case No: 96-3345
Eastern District of Arkansas
SPECIAL FILING 10:05 am
Challenge to contempt citation and incarcertaion for failure to testify
before the Grand Jury in Whitewater Matter. Held: appellant's Sixth
Amendment right to counsel was not violated when counsel was prevented
from accompaning client before the grand jury. Further, appellant's
exercise of Fifth Amendment protection in light of grant of use
immunity does not withstand legal scrutiny. Additionally, district
court did not abuse its discretion in denying motion for fully
public hearing on contempt citation. Affirmed.
