U.S. Court of Appeals Case No: 97-2694
Western District of Missouri
Civil Case; Writ of Habeas Corpus. Habeas relief granted where
prosecution used inconsistent, irreconcilable theories to secure
convictions against two defendants in prosecutions for the same
offense arising out of the same event. Due process violated because
error rendered unreliable the convictions for murder, armed criminal
action and robbery.
