U.S. Court of Appeals Case No: 97-6050
District of Nebraska
Disputed unsecured claims should be considered in determining a debtor's
eligibility for Chapter 13 relief; here, debtor's schedules and proofs
of claim established that his debts exceeded the $250,000 eligibility
limits of Section 109(e); where debtor's schedule and proof of claim
show he exceeds the eligibility limit, the court need not make a full
determination of the amount and validity of the disputed claims.
