U.S. Court of Appeals Case No: 98-2593
Southern District of Iowa
Prisoner case - habeas. Prosecutor's failure to provide Lingle with
doctor's report indicating sexual abuse victim's hymen was intact
did not affect outcome of trial as penetration is not an element
of the offense of second degree sexual abuse under Iowa law,
and the report did not necessarily contradict the victim's testimony.
