U.S. Court of Appeals Case No: 98-3265
and No: 98-3413
Western District of Missouri
Civil case - consumer law. In action alleging repossession actions
and deficiency suits violated Missouri law and the Truth In Lending
Act, the district court did not have jurisdiction over the claims
of the class alleging interest overcharges and erred in amending
the state court deficiency judgments; those claims should be
remanded to state court where the deficiency judgments were
entered. The court did have jurisdiction over the class claiming an
official fee overcharge as those claims fall under the Truth In
Lending Act.
