Criminal case - criminal law. District court did not err in
admitting testimony of defendant's wife when she voluntarily
waived the spousal testimonial privilege; district court
correctly calculated the amount of the loss, as the acts of
defendant's co-conspirators were reasonably foreseeable
and were in furtherance of the scheme; however, case
remanded to the district court for further findings as to
whether certain of the losses preceded defendant's participation
in the scheme.
