Civil case - torts. Because plaintiff's Rule 60(b) motion
was not filed within the thirty days permitted for filing a
notice of appeal from denial of a FRAP 4(a)(5) motion,
the district court erred in considering the 60(b) motion;
even if the motion were timely, the district court abused
its discretion in granting the motion because plaintiff failed
to show excusable neglect for not timely filing a notice of
appeal; appeal dismissed for lack of jurisdiction.
