U.S. Court of Appeals Case No: 99-1878
Eastern District of Missouri
Civil case - civil rights. Hiring of other carpenters did not
infer ADA discrimination on employer's part after plaintiff
was injured and not hired for spot work; employer was
under no duty to contact plaintiff every time it had spot
work; even assuming a prima facie case of discrimination,
plaintiff had not shown that the employer's stated reason
for not employing him - lack of work - was a pretext for
discrimination.
