U.S. Court of Appeals Case No: 99-2018
Eastern District of Arkansas
Civil case - civil rights. Plaintiff failed to establish that she
had a disability within the meaning of the ADA as she was
released to return to her prior duties as a cashier and her
remaining restrictions on daily life activities were moderate;
expression of concern over employee's condition, whether
through offer of leave or sending a card, does not amount
to treating the employee as if she had a permanent disability
that substantially limits her life activities.
