U.S. Court of Appeals Case No: 99-2052
Southern District of Iowa
Civil case - civil rights. District court erred in granting employer's
motion for a summary judgment on plaintiff's age discrimination claims;
plaintiff brought forth sufficient evidence to cast doubt on the employer's
stated grounds for transfer and raised a genuine issue of material fact as to
whether the reasons were pretextual; supervisors' remarks about age, when
considered in conjunction with plaintiff's prima facie case and showing of
pretext, give rise to an inference of intentional discrimination.
