Civil Case Civil Rights Action-First Amendment. District court committed plain error in instructing jury that if the jury found a First Amendment violation the jury had the discretion to award nominal damages. A award of nominal damages is required upon proof of infringement of the First Amendment right to speak. Case is reversed to enter judgment of $1.00 to plaintiff.
