U.S. Court of Appeals Case No: 99-3016
Eastern District of Missouri
Civil case - Family Medical Leave Act. For FMLA purposes,
demonstration that employee is unable to work in her current
job due to a serious health condition is enough to show that
the employee is incapacitated, even if that job is the only
one that the employee is unable to perform; reasonable jury
could find plaintiff's condition rendered her unable to perform
her duties for more than three consecutive days, and court
erred in granting employer a summary judgment.
