Criminal case - criminal law. Any error in admission of
possible hearsay evidence was harmless in light of the
fact defendant was acquitted on the count to which the
evidence pertained; imposition of enhancement because
defendant was a public official at time of the offense of
violating a citizen's civil rights was not double counting;
district court employed the wrong standard for determining
whether force was used or threatened; correct standard
for judging whether a defendant used or threatened force
is whether any force involved was sufficient to prevent the
victim from escaping the sexual contact; case remanded
for further consideration under the proper standard.
